Compliant with German Law (09/20/2025)
1.1 These Terms of Service (“Terms”) govern your use of all offers and services provided by the Seriux Network, which includes, but is not limited to, the Seriux Minecraft Network, the Seriux website and forum, official Seriux and SeriuxMod social media, and any related platforms (hereinafter referred to as “Server,” “Network,” “Services,” “we,” “our,” or “us”). By accessing or using any of these Services, you acknowledge and agree to be legally bound by these Terms and agree to comply with them fully.
1.2 These Terms apply to all users, including players, visitors, and registered members, as well as to all offers and services connected to or associated with the Seriux Network.
1.3 We reserve the right to amend these Terms at any time without prior notice. Any updated Terms will be published on our website or relevant platforms. It is your responsibility to review the current version regularly and ensure compliance.
1.4 Continued use of the Network after any changes to the Terms constitutes acceptance of the updated Terms. If you do not agree with the changes, you must discontinue use of all Services, and all your associated rights and privileges will lapse.
1.5 For legal purposes, the English version of these Terms is binding. In the event of discrepancies, the German version (if available) shall prevail to the extent required by law.
2.1 Use of the Network is permitted only with a legitimately purchased Minecraft account. Sharing, reselling, or using third-party accounts is strictly prohibited.
2.2 Users must be at least 13 years old to access the Network. Users under the age of 18 require the consent of a parent or legal guardian. We reserve the right to request proof of age or consent at any time, in accordance with Section 8 of the German Youth Protection Act (JuSchG).
2.3 All users are required to act fairly, respectfully, and in the best interest of the community. Any intentional disruption, harassment, or behavior contrary to the welfare of the community is prohibited.
2.4 Access to the Network may be restricted or prohibited in certain jurisdictions. It is your responsibility to ensure that your use of the Network complies with all applicable local laws and regulations.
3.1 Users must maintain a friendly and respectful environment towards other players and official team members at all times.
3.2 The following conduct is strictly prohibited: insults, discrimination, hate speech, threats, harassment, spamming, and advertising for non-official partners or third-party products or services.
3.3 The use of clients, cheats (including macros), bots, or mods that provide an unfair gameplay advantage is strictly forbidden. Permitted exceptions include mods for day/night adjustment or night vision. The Server team reserves the right to decide on the permissibility of specific mods.
3.4 Users are required to immediately report any game errors, bugs, or glitches to the Server team. Exploiting or disclosing such issues is prohibited and may result in sanctions or legal action.
4.1 All content and activities that violate applicable law, including German and European Union law, are strictly prohibited. This includes, but is not limited to, the dissemination of illegal content, copyright infringement, and violation of personality rights.
4.2 Commercial activities, such as the sale of virtual or real items, resources, or equipment, are not permitted without our express written consent.
4.3 Hostile actions against the Network or its Services, such as DDoS attacks, phishing, fraudulent methods, or any attempt to impair server performance or unlawfully obtain user data, are strictly prohibited and may result in criminal prosecution.
4.4 Impersonation of staff, team members, or other users, as well as the provision of false information during registration or support requests, is forbidden.
5.1 Violations of these Terms may result in sanctions, including but not limited to temporary or permanent restrictions on access or functionality (such as chat or voice channels), suspensions, or bans from the Network.
5.2 Users have the right to appeal sanctions or bans by submitting a written request via the official forum or support channels. The Server team will review appeals at its discretion. The right to appeal is forfeited if the user has violated applicable law or seriously endangered the community atmosphere.
5.3 The Server team holds domiciliary rights and may issue instructions to maintain order and safety. Failure to comply may result in immediate sanctions, including bans.
5.4 Where legally required, users will be notified of sanctions and the reasons for them, along with information on how to appeal.
6.1 We do not guarantee uninterrupted or error-free operation of our Services. Temporary disruptions, maintenance, or technical issues may occur at any time.
6.2 We accept no liability for loss of data, damage to hardware or software, or infections by viruses or other harmful components resulting from the use of our Services, except in cases of willful misconduct or gross negligence.
6.3 Our liability for damages, regardless of legal basis, is limited to cases of intent and gross negligence. In the case of slight negligence, we are only liable for damages resulting from injury to life, body, or health, and for breaches of cardinal obligations (essential contractual duties), with liability limited to the foreseeable, typical damage. Liability under the German Product Liability Act (Produkthaftungsgesetz) remains unaffected.
6.4 We assume no responsibility for content, products, or services of third parties that are linked or referenced by our Services.
7.1 The processing of personal data is governed by our external Privacy Policy, available at [LINK].
7.2 Users have the right to access, rectify, erase, restrict, or object to the processing of their personal data in accordance with the EU General Data Protection Regulation (GDPR) and the German Federal Data Protection Act (BDSG). Users may also file complaints with the competent data protection authority.
7.3 We implement appropriate technical and organizational measures to protect user data from unauthorized access, loss, or misuse. However, absolute security cannot be guaranteed.
8.1 By using our voice channels, you consent to your voice being recorded, used, and published as part of recordings or livestreams. Team members must be explicitly informed and must provide written consent before any recording or publication of audio or video involving them.
8.2 The recording or broadcasting of administrative actions (such as mediation talks, support tickets, chat logs, or support forum content) is strictly prohibited without express permission.
8.3 The publication or sharing of unreleased content (such as new features, events, builds), bugs, glitches, or other confidential information requires our explicit written consent, to be granted via the forum or upon written request.
9.1 These Terms are governed by the laws of the Federal Republic of Germany. Mandatory consumer protection provisions of the country in which the user has their habitual residence remain unaffected.
9.2 If the user is a merchant, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from or in connection with these Terms is our registered office. For consumers, the statutory places of jurisdiction apply.
9.3 Should any provision of these Terms be or become wholly or partially invalid or unenforceable, the validity of the remaining provisions shall remain unaffected. The invalid or unenforceable provision shall be replaced by a valid provision that comes closest to the economic intent of the invalid provision. The same applies in the event of a regulatory gap.
9.4 Amendments and supplements to these Terms must be made in writing. This also applies to the waiver of the written form requirement, unless a more stringent form is required by law.
